TERMS OF SERVICE

1. Agreement and Acceptance by Use

These Terms of Service govern access to and use of www.PilotTrainingSystem.com, 107.PilotTrainingSystem.com, pts-ui.vercel.app and all related and affiliated websites, eLearning courses, accounts, applications, content and services operated by Pilot Training System, LLC (“PTS,” “we,” “us” or “our”).

These Terms apply to every person who accesses or uses the Services, including visitors, registered users, eLearning participants, purchasers, program applicants and persons who use PTS to inquire about, access, coordinate or participate in services offered by a college, flight school, lender or other Independent Provider.

By accessing, browsing or continuing to use the Services; creating or accessing an account; viewing or completing eLearning content; submitting a form; making a purchase; requesting information or a referral; or using PTS in connection with an Independent Provider, you acknowledge that you have notice of and agree to be bound by these Terms and the Privacy Policy.

If you use the Services on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms and the Privacy Policy, you must not access or use the Services.

2. Aviation Education Disclaimer

PTS provides supplemental aviation education and career information. Our content is not a substitute for instruction from an appropriately certificated flight instructor, current FAA publications, applicable regulations, aircraft operating limitations, weather information, required preflight planning or sound aeronautical decision-making.

Users are responsible for confirming that all information is current and appropriate before applying it to any flight, training activity or aviation operation. PTS content must not be used as the sole source of information for an actual flight or safety-critical decision.

Completion of a PTS course does not itself confer an FAA pilot certificate, rating, endorsement, medical certificate, operational authorization or guarantee of success on an FAA knowledge or practical examination.

3. Eligibility and Accounts

The Services are not directed to children under 13. Users under 13 may not create an account or provide personal information unless PTS has implemented legally required parental-consent procedures.

Users ages 13 through 17 may use the Services only with permission and supervision from a parent or legal guardian. By permitting a minor to use the Services, the parent or guardian accepts responsibility for the minor’s use.

You agree to provide accurate information, protect your login credentials and notify PTS promptly at info@PilotTrainingSystem.com if you suspect unauthorized access to your account. You may not share, sell or transfer your account credentials.

4. Acceptable Use

You may use the Services only for lawful, personal and educational purposes. You may not:

• Copy, republish, sell or distribute course content without written permission;

• Share account credentials or allow unauthorized users to access restricted content;

• Circumvent security, access controls or course requirements;

• Scrape, download or systematically collect content or user information;

• Upload malicious code or interfere with the operation of the Services;

• Impersonate another person or provide false account information; or

• Use the Services in a way that violates applicable law or the rights of another person.

PTS may investigate suspected misuse and take reasonable steps to protect its users, content and systems.

5. Intellectual Property

The Services and their original software, videos, assessments, graphics, text, logos, course organization and other content are owned by or licensed to Pilot Training System, LLC and are protected by applicable intellectual-property laws.

PTS grants you a limited, revocable, nonexclusive and nontransferable license to access and use the Services for personal, noncommercial education. This license does not transfer ownership or permit reproduction, resale, public display, distribution, modification, reverse engineering or creation of derivative works without prior written permission.

Government publications and third-party materials remain the property of their respective owners.

6. Colleges, Flight Schools and Other Independent Providers

PTS works with independent colleges, flight schools, lenders, testing providers and other organizations (“Independent Providers”). Unless expressly stated in a separate written agreement, PTS does not own, operate or control these Independent Providers.

Independent Providers are solely responsible for the services they provide, including admissions, tuition, flight-training fees, financing, refunds, scheduling, instructors, aircraft, maintenance, insurance, regulatory compliance, safety and the conduct of their employees and contractors.

PTS may introduce students to Independent Providers and may market, coordinate or administer portions of a program. These activities do not make PTS the provider of flight instruction, aircraft rental, college instruction, financing or any other service furnished by an Independent Provider.

Each Independent Provider’s services are governed by the contract between the student and that provider. PTS is not responsible for an Independent Provider’s acts, omissions, representations, service interruptions, pricing, refund decisions or failure to perform.

Nothing in this section limits an obligation that PTS has expressly assumed in a separate written agreement or any responsibility that cannot legally be disclaimed.

7. Purchases, Partner Charges and Refunds

PTS Purchases

PTS may offer products or services directly, including course-completion certificates, merchandise or premium digital features. A checkout page or receipt will identify PTS when PTS is the seller. Prices, delivery conditions and applicable refund terms will be displayed before purchase.

Unless a different policy is displayed at checkout, purchases of digital products and certificates from PTS are final after delivery. Refund requests may be submitted to info@PilotTrainingSystem.com and will be considered based on the circumstances, but approval is not guaranteed. Nothing in this section limits rights required by applicable law.

A PTS course-completion certificate documents completion of a PTS course only. It is not an FAA pilot certificate, rating, endorsement, knowledge-test result or operational authorization.

Third-Party Charges

Tuition, flight-training fees, aircraft-rental charges, instructor fees, examination fees, financing charges and other amounts charged by a college, flight school, lender or other Independent Provider are not purchases from PTS unless the checkout page or receipt expressly identifies PTS as the seller.

Third-party charges, deposits, payment schedules, cancellations, credits and refunds are governed by the applicable agreement between the student and the Independent Provider. Questions or disputes concerning those charges must be directed to the organization that collected or received the payment.

8. Separate Agreements and Order of Precedence

Certain programs, purchases or services may require a separate written agreement with PTS, a college, a flight school, a lender or another Independent Provider.

These Terms govern use of the PTS websites, online courses and services. A separately signed student-enrollment, flight-training, college, financing or services agreement governs the specific services covered by that agreement.

If these Terms conflict with a separately signed agreement, the separately signed agreement will control with respect to its specific subject matter. These Terms do not amend, replace or waive the rights or obligations contained in any separate written agreement.

9. Suspension and Termination

PTS may suspend or terminate access when reasonably necessary to address a violation of these Terms, suspected fraud, unauthorized access, security concerns, legal requirements or conduct that threatens PTS, its users or its systems.

You may stop using the Services at any time and may request account deletion as described in the Privacy Policy.

Provisions concerning intellectual property, disclaimers, liability, indemnification, disputes and governing law will survive termination when their nature requires it.

10. Warranty Disclaimer and Limitation of Liability

To the fullest extent permitted by law, the Services and content are provided “as is” and “as available.” PTS disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted availability and error-free operation.

PTS does not guarantee that its content will always be complete, current or suitable for a particular training or operational purpose.

To the fullest extent permitted by law, PTS and its owners, managers, officers, employees and agents will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Services.

PTS’s total liability for a claim relating to the Services will not exceed the amount you paid directly to PTS during the 12 months preceding the claim or $100 if you paid nothing, unless applicable law requires otherwise.

These limitations do not exclude liabilities that cannot legally be excluded or limited. They also do not alter any responsibility expressly assumed by PTS in a separate written agreement.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless PTS and its owners, managers, officers, employees and agents from third-party claims, liabilities, losses and reasonable expenses, including reasonable attorneys’ fees, arising from:

• Your unlawful use of the Services;

• Your material violation of these Terms;

• Your fraudulent, false or misleading information;

• Your infringement of another person’s rights;

• Your violation of an agreement with a college, flight school or other Independent Provider; or

• Bodily injury or property damage caused by your wrongful or negligent conduct.

This provision does not require you to indemnify PTS for a claim to the extent caused by PTS’s gross negligence, fraud or willful misconduct, or solely by the acts of an Independent Provider that were not directed or controlled by PTS.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Before filing a legal action, you and PTS agree to make a good-faith effort to resolve the dispute informally. A written notice describing the dispute should be sent to info@PilotTrainingSystem.com.

Unless applicable law requires otherwise, any legal proceeding relating to these Terms or the Services must be brought in a state or federal court with jurisdiction in Volusia County, Florida. You and PTS consent to the jurisdiction of those courts.

13. Changes, Severability and Contact

PTS may update these Terms to reflect changes in its Services, business practices or legal obligations. The effective date at the top of this page will be updated when changes are made. When reasonably practical, PTS will provide additional notice of material changes.

If any provision is found unenforceable, the remaining provisions will continue in effect.

These Terms and the Privacy Policy constitute the agreement between you and PTS regarding use of the PTS websites, online courses and services, except when a separate written agreement applies to a particular program, provider, service or purchase.

PRIVACY POLICY

1. Information We Collect

PTS may collect information you provide directly, including:

• Name, email address, telephone number and mailing address;

• Account login and profile information;

• Course enrollment, progress, quiz results and completion records;

• Contact-form submissions and communications;

• Program, college, flight-school and location interests;

• Purchase and transaction information; and

• Information submitted when requesting support, exercising privacy rights or requesting account deletion.

PTS and its service providers may also automatically collect device, browser, IP address, cookie, log, usage and approximate-location information when you use the Services.

PTS does not intend to collect Social Security numbers, medical records, financial-account credentials or other unnecessary sensitive information through its general website forms. Please do not submit sensitive information that PTS has not specifically requested.

2. How We Use Information

PTS may use information to:

• Create and manage accounts;

• Provide courses and track educational progress;

• Respond to questions and program inquiries;

• Connect interested users with relevant PTS programs or Independent Providers when requested;

• Administer or coordinate programs involving colleges and flight schools;

• Process purchases made directly from PTS;

• Provide certificates or other products;

• Send service-related communications;

• Send marketing email when permitted, with an unsubscribe option;

• Maintain, secure and improve the Services;

• Detect fraud, misuse or unauthorized access; and

• Comply with legal, accounting and contractual obligations.

Submitting a contact form authorizes PTS to respond to that inquiry. It does not enroll you in recurring marketing text messages unless you separately agree to receive them.

3. How Information Is Shared

PTS may share information with service providers that perform functions on its behalf, including website hosting, online course delivery, customer-relationship management, email, analytics, data storage, security and payment processing. These providers may include Wix, Google, HubSpot, Vercel and payment processors used at the time of purchase.

PTS may also share information:

• At your request or with your consent;

• With a college, flight school or other program partner when reasonably necessary to provide a requested service;

• When required by law, court order or governmental request;

• To investigate fraud, protect safety or enforce these Terms; or

• In connection with a merger, financing, reorganization or transfer of business assets.

When PTS shares personal information with a college, flight school or other program partner, PTS will limit the disclosure to information reasonably necessary to respond to an inquiry, administer the applicable program, provide a requested service or satisfy a legal or contractual obligation.

A college, flight school or other Independent Provider may separately collect and control information under its own privacy policy and student agreement. PTS is not responsible for an Independent Provider’s independent privacy practices.

PTS will disclose confidential or proprietary information belonging to a college, flight school or other contracting party only as permitted by the applicable written agreement or required by law.

PTS does not sell account information for monetary payment. Some analytics or advertising technologies may be treated as “sharing” under certain state privacy laws. Where required, PTS will provide applicable choices or opt-out rights.

4. Cookies and Analytics

PTS and its service providers may use cookies and similar technologies to operate the Services, maintain sessions, remember preferences, understand website usage and measure marketing performance.

You may control cookies through your browser settings and any cookie-preference tools made available through the website. Disabling some cookies may prevent portions of the Services from functioning correctly.

If PTS uses technologies that require consent or an opt-out under applicable law, PTS will provide the required notice or control.

5. Data Retention and Security

PTS retains personal information for as long as reasonably necessary to provide the Services, maintain course and transaction records, administer partner programs, resolve disputes, enforce agreements and comply with legal obligations.

Account and course-progress information may be retained while an account remains active and for a reasonable period afterward. Some information may remain temporarily in secure backups or may be retained when required for legal, accounting, contractual, safety or fraud-prevention purposes.

PTS uses reasonable administrative, technical and organizational measures to protect information. However, no website, transmission or storage system can be guaranteed completely secure.

PTS requires service providers and program partners receiving information from PTS to handle that information consistently with their contractual obligations and applicable law.

6. Your Choices and Privacy Rights

You may unsubscribe from promotional email by using the unsubscribe link in the message.

You may request access to, correction of or deletion of your personal information by emailing info@PilotTrainingSystem.com.

PTS may need to verify your identity before completing a request. Certain information may be retained when required by law or reasonably necessary for security, fraud prevention, course records, accounting, contractual compliance or dispute resolution.

Information maintained independently by a college, flight school, lender or other Independent Provider must generally be requested directly from that organization.

Depending on where you live, you may have additional rights concerning access, correction, deletion, portability or certain uses of your personal information. PTS will respond to verified requests as required by applicable law.

7. Children’s Privacy

The Services are not directed to children under 13, and PTS does not knowingly collect personal information directly from children under 13 without legally required parental consent.

If you believe a child under 13 has provided personal information to PTS, contact info@PilotTrainingSystem.com so the information can be reviewed and, when appropriate, deleted.

Users ages 13 through 17 should use the Services only with permission from a parent or legal guardian.

A parent or legal guardian permitting a minor to participate in a college or flight-training program should also review the privacy practices and enrollment agreements of the applicable college, flight school and other Independent Providers.

8. External Services and International Access

The Services may link to websites or services operated by Independent Providers and other third parties. Their privacy practices are governed by their own policies, and PTS is not responsible for their independent privacy practices.

PTS is based in the United States. If you access the Services from another country, your information may be processed and stored in the United States or other locations where PTS’s service providers operate.

9. Privacy Policy Changes and Contact

PTS may update this Privacy Policy to reflect changes in its practices, technology, programs, service providers or legal obligations. The effective date at the top of this page will identify the latest revision.

When reasonably practical, PTS will provide additional notice of a material change affecting registered users.
